These Terms of Service (“Terms”) govern your use of the SkyMarket Aviation website located at skymarketaviation.com (the “Platform”) and all related services. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Platform Overview
SkyMarket Aviation operates an online marketplace that connects aircraft buyers and sellers. SkyMarket Aviation is not a broker, dealer, or party to any transaction. We provide a platform for listing and discovering aircraft. All transactions are conducted directly between buyers and sellers. SkyMarket Aviation does not buy, sell, trade, inspect, appraise, finance, or take possession of any aircraft.
2. Eligibility
You must be at least 18 years of age and legally able to form binding contracts to use the Platform. By creating an account, you represent that all information you provide is accurate, current, and complete, and that you will keep it updated.
3. Account Registration
Certain features of the Platform require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. SkyMarket Aviation reserves the right to suspend or terminate accounts that violate these Terms.
4. Listing Aircraft
4.1 Seller Responsibilities
If you list an aircraft on SkyMarket Aviation, you represent and warrant that:
- You are the legal owner of the aircraft or are authorized by the owner to list it for sale.
- All information in the listing (including descriptions, specifications, images, hours, maintenance records, and pricing) is accurate, truthful, and not misleading.
- The aircraft has a valid airworthiness certificate or you have clearly disclosed its status.
- You will comply with all applicable federal, state, and international aviation regulations, including FAA regulations where applicable.
- You will respond to buyer inquiries in good faith and in a timely manner.
4.2 Prohibited Listings
You may not list aircraft that are stolen, subject to undisclosed liens or encumbrances, involved in pending legal disputes, or otherwise not legally available for sale. SkyMarket Aviation reserves the right to remove any listing at its sole discretion without notice.
5. Buying Aircraft
SkyMarket Aviation provides information to help you discover aircraft, but we strongly recommend that all buyers conduct their own independent due diligence before any purchase, including but not limited to:
- Independent pre-purchase inspection by a qualified aviation mechanic or facility.
- Title search through the FAA Aircraft Registry or equivalent authority.
- Review of all maintenance records and logbooks.
- Verification of airworthiness directives (AD) compliance.
- Consultation with an aviation attorney regarding the transaction.
- Verification of the seller’s identity and legal authority to sell.
SkyMarket Aviation does not guarantee the accuracy of any listing information, the condition of any aircraft, or the outcome of any transaction.
6. AI-Powered Features
SkyMarket Aviation offers AI-powered tools including market valuations, search assistance, and maintenance cost predictions. These features are provided for informational purposes only and should not be relied upon as the sole basis for any purchase, sale, or financial decision. AI-generated valuations are estimates and may not reflect actual market value. Always obtain professional appraisals and inspections before making transaction decisions.
7. Subscription Plans and Payments
SkyMarket Aviation offers paid subscription plans for sellers (Standard, Featured, and Dealer). By subscribing to a paid plan:
- You authorize us to charge the applicable fees to your payment method via Stripe.
- Subscriptions automatically renew at the end of each billing cycle unless cancelled.
- You may cancel your subscription at any time through your account settings or the Stripe Customer Portal.
- Refunds are handled on a case-by-case basis at SkyMarket Aviation’s discretion.
- We reserve the right to change pricing with 30 days advance notice.
8. Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent listings or information.
- Use the Platform for any unlawful purpose or in violation of aviation regulations.
- Harass, threaten, or defraud other users.
- Scrape, crawl, or use automated means to extract data from the Platform without written permission.
- Attempt to circumvent any security features of the Platform.
- Impersonate any person or entity or misrepresent your affiliation.
- Interfere with the proper functioning of the Platform.
- Use the Platform to facilitate money laundering or sanctions evasion.
9. Intellectual Property
All content on the Platform (including design, text, graphics, logos, software, and the SkyMarket Aviation name and brand) is owned by SkyMarket Aviation or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent. Sellers retain ownership of their listing content but grant SkyMarket Aviation a non-exclusive license to display it on the Platform.
10. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SkyMarket Aviation does not warrant that the Platform will be uninterrupted, error-free, or secure.
SKYMARKET AVIATION IS NOT RESPONSIBLE FOR ANY TRANSACTION BETWEEN USERS. We do not verify aircraft condition, ownership claims, maintenance history, or seller credentials beyond our optional verification program. Any verification badges are based on limited checks and do not constitute a guarantee.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYMARKET AVIATION’S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO SKYMARKET AVIATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL SKYMARKET AVIATION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Indemnification
You agree to indemnify, defend, and hold harmless SkyMarket Aviation, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Platform, your listings, any transaction you enter into through the Platform, or your violation of these Terms.
12. Dispute Resolution
Any disputes arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation. If unresolved after 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Texas. You agree to waive any right to a jury trial or to participate in a class action.
13. SMS Terms
SkyMarket Aviation may send transactional SMS notifications to users who have opted in. The following terms apply.
What you’ll receive: Account-related notifications about new inquiries on your listings, new messages from other users, grants of document access, verification status updates (identity, pilot, funds), and account security events. Message frequency varies based on your platform activity, typically 1–10 messages per week. No marketing or promotional content is sent.
Costs: Standard message and data rates apply at your carrier’s standard pricing. SkyMarket does not charge for SMS notifications.
Phone number privacy: SkyMarket Aviation does not share, sell, rent, or otherwise disclose phone numbers collected for SMS notifications to third parties or affiliates for marketing purposes. Phone numbers are used solely to deliver the notifications you have opted in to receive.
Opting out: Reply STOP, OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, or STOPALL to any SMS message to unsubscribe immediately. You may also disable SMS notifications in your account settings at /account/notifications.
Help: Reply HELP or INFO to any SMS message for support information, or contact support@skymarketaviation.com.
Carriers: Carriers are not liable for delayed or undelivered messages.

14. Modifications
SkyMarket Aviation may update these Terms at any time. We will notify users of material changes via email or a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law principles.
